Testing inaccuracies
An evaluation of the methods by which breath, urine, or blood tests were undertaken is made to check for irregularities. These tests are not always completely reliable and in some cases can be thrown out as defective. Additionally, the tests have to be administered in accordance with state procedures.
Police mistakes
The police must show that when they pulled your car over they had a reason to do so. Also, if Miranda warnings were not given, incriminating statements made at the scene may not be admissible.
Witness testimony
There may be individuals who can testify that you appeared sober.

Advising about special programs
In Pennsylvania there is a special form of probation called accelerated rehabilitative disposition (ARD). Under this program, fines may be reduced or the length of time that a driver's license is suspended may be shortened. We advise clients about this program when they may qualify.
A DUI offense may be eligible for accelerated rehabilitative disposition (ARD) when:
- It is a first offense within ten years.
- No person, other than the offender, was killed or seriously injured.
- There was no passenger in the vehicle under the age of 14
A conviction for DUI or DWI can be quite serious. Jail, probation, and suspension of the driver's license are possible. Fines can exceed $4,000. Generally, the higher a person's alcohol level the stiffer the sentence. Second and third offenses can result in suspension of the driver's license for up to one year and a longer jail sentence, depending on how much alcohol was consumed.
