Resolving environmental problems in commercial real estate transactions
When a client is considering a purchase of business property, we order an environmental study, among other actions. Sometimes unforeseen problems arise, such as evidence of a past chemical spill or another environmental concern. When a problem like this is discovered, the buyer can eventually become responsible for problems that they knew about at the time of purchase. It is important for the buyer to know what repairs are necessary before they make the purchase.
The seller is not automatically obligated to take care of the problems that are found and they may become negotiating points. Governmental authorities may become involved, too. Sigmon & Sigmon, P.C. often resolves these issues without litigation. We negotiate with the seller about who will pay for the remedy. We also negotiate with the governmental entities as to the nature and extent of remedial actions required to resolve the matter.
